Booking Conditions — International
1. Our contract

The first named person on the booking (“party leader”) must be authorised to make the booking on the basis of these booking conditions by all persons named on the booking and by their parent or guardian for all party members who are under 18 when the booking is made. By making a booking, the party leader confirms that he/she is so authorised. The party leader is responsible for making all payments due to us and will be our point of contact. The party leader must be at least 18 when the booking is made. It will be the responsibility of the party leader to ensure that each traveller has read, understood, and agrees to these terms and conditions.

Your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice.

2. Validity

Dates and itineraries are valid for the season as stated on the booking confirmation. Beyond two years from the booking date, dates and itineraries are indicative only and subject to confirmation closer to the season.

3. Deposit requirement

A non-refundable deposit is required for your booking to be confirmed. For private charters booked more than 12 months before departure: 25% deposit. For bookings 12 months or less before departure: 50% deposit. Deposits must be made within five (5) business days from reservation. If booking less than twelve (12) weeks before departure, payment is required in full. For B2B partnership bookings, the cascade structure in Clause 11.5 applies in lieu of these terms.

If a special charter has been arranged, a 50% non-refundable deposit will be required within 5 business days of booking.

We prefer a bank-to-bank transfer. If paying by credit card, we will add a 4% fee to the total bill.

If we do not receive all payments due (including any surcharge where applicable) in full and on time, we are entitled to assume that you wish to cancel your booking. In this case, we will be entitled to keep all deposits paid or due at that date. If we do not cancel straight away because you have promised to make payment, you must pay the cancellation charges as set out by us.

5. Prices and surcharges

Our trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply.

Our prices are based on full occupancy of the boats, therefore it’s financially impossible for solo travellers to occupy a double cabin at the per-person rate.

All monetary figures are in Euro (EUR €) and all payments are inclusive of VAT and any other taxes unless otherwise stated.

If you would prefer to use an alternative currency, please let us know.

6. Your details

For us to confirm your travel arrangements, you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements.

7. Special requests and medical conditions / disabilities / reduced mobility

If you have any special request, you must advise us at the time of booking. Although we will endeavour to accommodate any reasonable request, we regret we cannot guarantee any request will be met unless we have specifically confirmed it. Failure to meet any special request will not be a breach of contract on our part. Confirmation that a special request has been noted or the inclusion of the special request on your confirmation invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability.

Sailing can be hard and requires a reasonable level of physical and mental strength. You will be expected to be able to participate in all aspects of sailing a yacht, and should be physically and mentally able to do so. If you suffer from any medical condition, disability or reduced mobility which may affect your holiday or have any special requirements as a result (including any which affect the booking process), please tell us before you confirm your booking so that we can assist you in considering the suitability of the arrangements and/or making the booking. In any event, you must give us full details in writing at the time of booking and whenever any change in your condition, disability or mobility occurs. You must also promptly advise us if any medical condition, disability or reduced mobility which may affect your holiday develops after your booking has been confirmed.

8. Cabin allocation

When booking a partial cabin (shared cabin) or private cabin, we reserve the right to change the cabin allocation. We respect a cabin preference, however there is the rare occasion we will need to shuffle cabin allocations to make the boat bookings work.

9. Provided or can be arranged on the yacht

One set of linen will be supplied for everyone on board, including a towel and hand towel. We will also provide bed sheets (top and bottom), pillow, pillowcase, and blanket. Beach towels are not provided as standard but can be arranged as a paid extra.

Snorkel sets and paddleboards (SUP) are provided as standard on each yacht. Additional paddleboards, kayak (~€180/week), and other water toys are available as paid extras at supplier rates — please request these at the time of booking.

10. Private Charter

For a private charter:

Security deposit — With all private charters, guests will be required to leave a security deposit at the charter company base. The amount will be blocked and released without charge when the boat completes ‘check-out’ without any damages. If there are damages caused by the skipper, the skipper’s insurance will cover the damage costs. Amounts blocked will range from €2,000 to €5,000 depending on the boat. This amount may be larger depending on the value of the boat chartered.

For a private charter that is outside of our scheduled publicly advertised voyages, we will be required to charter an additional boat(s) and crew. As the boats and crew are not under the management of Sailing2Wellness, we cannot guarantee the condition of the boat, nor be held responsible for a poorly maintained vessel.

If you cancel a private charter, we will try to recover your deposit however if the charter company imposes a penalty, these will be at your expense not ours.

11. Cancellation by you

If you cancel some or all portions of your booking the cancellation terms set out below will apply. A cancellation will only be effective when we receive written confirmation that you have sent to your relevant sales representative of the cancellation. If you cancel a trip:

  • within 7 days of your booking: 100% refund
  • after 7 days and more than 12 weeks before the departure date: we will hold the deposit amount
  • 12 weeks or fewer prior to the departure date: 0% refund

Any credit resulting from a cancellation under this clause may be applied towards any other available trip offered by us. This credit is not transferrable or redeemable for cash. This credit excludes flights or insurance as they will have their own booking conditions.

11.5 B2B partnership bookings — cascade structure

For B2B partnership bookings (where Sailing2Wellness contracts with a partner travel organisation rather than directly with end-travellers), the cancellation cascade set out in the partnership agreement signed between Sailing2Wellness and the partner organisation governs and supersedes the schedule above. Typical cascade structure:

  • refundable holding deposit at signing;
  • a non-refundable deposit (typically 25% of the charter base) due when an agreed sales milestone is reached;
  • a second non-refundable deposit (typically 25% of the charter base) at a further agreed milestone;
  • final balance payable in full no later than 12 weeks before departure.

Specific stage triggers, milestone definitions, and refund schedules are set out in the partnership agreement. Where the partnership agreement conflicts with these Booking Conditions, the partnership agreement governs.

12. Cancellation by us

In the event that we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a refund, unless your trip is cancelled due to a Force Majeure Event (as defined below).

Cancellation due to Force Majeure

If a trip is cancelled due to a Force Majeure Event, we can offer you a choice of:

  • (a) a 100% credit of monies paid for your trip; or
  • (b) a refund minus unrecoverable costs.

If the cancellation due to a Force Majeure Event occurs after a trip has commenced, we can offer you a choice of a pro-rata:

  • (a) 100% credit for the days that remain on your trip; or
  • (b) refund minus unrecoverable costs of the days that remain on your trip.

Any credit resulting from a cancellation under this clause:

  • may be applied towards any other available trip offered by us;
  • is not redeemable for cash;
  • excludes flights or insurance as they will have their own booking conditions.

A “Force Majeure Event” includes but is not limited to: acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union dispute; earthquake; epidemic, pandemic or other health emergency; flood; windstorm or other extreme weather event; lack or failure of courses of supply; passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable, which would make it dangerous or not viable for a trip to commence or continue.

In the event of any cancellation, there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

13. Booking amendments

A change of booking has the same result as a cancellation for us and our financial commitments and limited time to replace a booking.

  • Within 7 days of your booking: free of charge
  • After 7 days of your booking and more than 12 weeks from the departure date: €100 change per person (approval required from us)
  • Less than 12 weeks from departure: No change possible, we treat it as a cancellation and 0% refund.
14. Inclusions

The price of your private charter includes:

  • the chartered yacht for the agreed week
  • captain and chef onboard
  • half-board: breakfast and lunch cooked daily by the onboard chef
  • fuel for the agreed sailing programme
  • marina and harbour fees
  • boat toys: paddleboards (SUP) and snorkel kit
  • linens, towels (shower / hand), bed linen, on-board essentials
  • WiFi on board

On request we can arrange vegetarian and vegan meals. Notify us of any allergies or other preferences in time, as we provision a week in advance. In failure to notify us of your preferences, we may not be able to accommodate you accordingly.

15. Exclusions

The price of your trip does not include:

  • international or internal flights
  • airport transfers, taxes and excess baggage charges unless specified
  • dinners ashore
  • drinks and bar tab onboard
  • visa and passport fees
  • vaccinations
  • travel insurance
  • optional excursions and activities
  • crew gratuities (suggested 10–15% of the charter)
  • all personal expenses
16. Passport and visas

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region you visit on your trip. This includes a valid passport and all travel documents required by us and/or the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. Your passport must be valid 6 months after the last date of travel as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the trips, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by us that is a direct result of your failure to secure or be in possession of proper travel documentation.

17. Travel insurance

Travel insurance is mandatory for all our travellers and must be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation (CFAR; Cancel For Any Reason), curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company’s 24-hour emergency contact number on the first day of your trip; you will not be able to join the trip without these details. If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank’s name and credit card details.

18. Change of itinerary

You appreciate and acknowledge that the nature of this type of travel requires considerable flexibility and you should allow for alternatives.

Our skippers will follow the itinerary, however, there may be circumstances out of their control where this may not be possible. The skipper has the authority to change the itinerary when and where he/she deems fit. These will be for safety reasons or adverse weather conditions. Dangerous winds may dictate we take another marina/port/berth to the listed itinerary.

19. Authority on board

Our trips are run by the skipper. The decision of the skipper is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by the skipper, or interfere with the well-being or mobility of the group, the skipper may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited.

A responsible level of behaviour and consideration is expected whilst you are on board our yachts and you must comply with the yacht’s rules and regulations. You will be liable for any damage or loss caused by you or by person(s) in your party whilst on board. If you or any person(s) in your party are deemed to be in our reasonable opinion behaving in a manner which is likely to cause danger or distress to any third party or property, we are entitled to terminate our agreement with the person(s) involved without notice or refund. We also have the right to remove the person(s) involved from the vessel and have no further responsibilities towards the person(s).

If the matters are serious, the local Police may be involved.

20. Acceptance of risk

You acknowledge that the nature of the trip may be adventurous and participation involves a degree of personal risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives.

You acknowledge that travel may at times involve elevated public-health risks (for example, infectious disease epidemics or pandemics). Sailing2Wellness will take reasonable steps to maintain safety on board and may require you to follow additional safety protocols where applicable.

We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However, it is also your own responsibility to acquaint yourself with all relevant travel information, including applicable health risks and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. To the fullest extent permitted by law, we accept no liability in relation to these additional risks.

21. Liability and service guarantee

Dutch law applies to all offers, requests, orders, and agreements of Sailing2Wellness. Any disputes arising from or related to these Booking Conditions shall be resolved by the competent courts of the Netherlands.

21.1 Limitation of contractual liability

Sailing2Wellness’s contractual liability to you under these Booking Conditions is limited to the total amount you have paid for the booking. Neither Party shall claim loss of profit, loss of opportunity, or other indirect or consequential losses from the other under these Booking Conditions.

21.2 Mandatory consumer protection

Nothing in these Booking Conditions limits or excludes any liability that cannot be limited or excluded under mandatory Dutch consumer law, including (but not limited to) liability for personal injury or death caused by Sailing2Wellness’s negligence, and liability arising from fraud or wilful misconduct. Where the law implies a warranty into these Booking Conditions which may not lawfully be excluded, our liability for breach of such a warranty is limited to either supplying the affected services again or paying the cost of having the services supplied again.

21.3 Indemnity from you

You indemnify Sailing2Wellness (and all of its officers, employees, contractors and agents) against losses, claims, actions, proceedings, damages, costs and expenses (including legal fees) arising from any claim by a third party arising directly or indirectly out of (a) your access or use of the Services, including your delegate’s access or use of the Services, and (b) any breach by you (or your delegate) of these Booking Conditions or any additional terms applicable to providing the Services, except to the extent caused by Sailing2Wellness’s negligence, fraud, or wilful misconduct.

21.4 Third-party suppliers

Sailing2Wellness contracts with a network of third-party providers (vessel owners, restaurants, excursion providers, transfer operators, accommodation providers, airlines, tour and local guides, government agencies, independent contractors and individuals) to assist in the running of trips, acting as agent for these third parties. Although Sailing2Wellness takes reasonable steps to select reputable providers, Sailing2Wellness cannot be held responsible for the acts or omissions of these third parties. Vessel-side faults (hull, machinery, seaworthiness, structural failure, crew employment) fall under the vessel owner’s hull insurance and Protection & Indemnity coverage. Disputes between you and any third-party provider are to be resolved between you and that provider.

21.5 Vicarious liability

Sailing2Wellness shall not be vicariously liable for the intentional or negligent acts of any persons not employed by Sailing2Wellness, nor for any intentional or negligent acts of its employees committed while off duty or outside the course and scope of their employment.

22. Insurance carried by Sailing2Wellness

22.1 Marine third-party liability

Sailing2Wellness carries Skipper Third Party Liability Insurance through Pantaenius (Policy 11699722, lead underwriter Chubb European Group SE; consortium underwriters: Allianz Global Corporate & Specialty SE, Kravag Logistic Versicherungs AG, AIG Europe S.A.). Coverage limits: combined single limit per claim event €6,000,000 (personal injury and property damage); maximum per person personal injury €3,000,000; pecuniary damages €250,000; annual aggregate twice the sum insured. Commercial use is endorsed. Coverage is worldwide, excluding the territorial waters of the United States. A copy of the policy certificate is available upon request.

22.2 Coverage scope

This insurance covers third-party legal liability claims arising from Sailing2Wellness’s negligence in skippering or operating the chartered yacht. It does not cover purely contractual liability beyond legal negligence (such as cancellation refund obligations or contractual indemnification), which is addressed under the cap in Clause 21.1.

22.3 Vessel-side coverage

The vessel owner of each chartered yacht maintains hull insurance and Protection & Indemnity (P&I) coverage as required under applicable maritime regulations. Vessel-side faults fall under the vessel owner’s coverage chain.

23. Optional activities

Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance, recommendations or advice given by your group leader or local representative in arranging optional activities (including before or after a trip) does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider.

24. Claims & complaints

In the unlikely event that you have any reason to complain or may have a basis for making a claim in respect of any aspect of your holiday arrangements whilst away, please inform your Skipper at the time so that they can attempt to rectify the matter. If you believe that your complaint has not been resolved through these means then any further complaint should be put in writing to us within 30 days of the end of the trip, sent to [email protected].

25. Privacy policy

Any personal information that we collect about you will be handled in accordance with our Privacy Policy and may be used for any purpose associated with the operation of a trip. In making this booking you consent to this information being passed on to the relevant persons such as our agents, service providers or other suppliers to enable us to operate the trip or, if permitted by any relevant Spam laws, to send you marketing material in relation to our events and special offers.

You are responsible for reviewing this Privacy Policy periodically and informing yourself of any changes to this Privacy Policy.

26. Rights and use of digital media

If a photographer or another employee is taking photographs/video and you have an objection to these being used by us, please make your objection known at the time. We may publish digital media to a web platform and/or use it for marketing purposes.

27. Changes

We reserve the right to amend these terms and conditions at any time, without notice to you.

We reserve the right to change the pricing structure of our tours without notice.

We reserve the right to change any part of the itinerary, whether we published the amends online or not. If there are not enough bookings on the trip, we reserve the right to combine boats, which may or may not alter the proposed itinerary.
